Documenting the Battle for Transgender Legal Protections: A Powerful Documentary Shows the Personal Narrative

Trans director Sam Feder's newest film "Heightened Scrutiny" presents a moving two-part viewpoint – simultaneously an emotional portrait of a prominent transgender advocate and a critical examination of media reporting surrounding transgender issues.

Judicial Struggle at the Highest Court

This feature follows ACLU attorney Chase Strangio as he prepares for court proceedings in the important Supreme Court case the Skirmetti case. This legal battle occurred in late 2024, with the judiciary finally ruling in support of Tennessee's position, effectively permitting bans on treatment for transgender minors to stay in place across numerous US territories.

We created Heightened Scrutiny in merely 16 months, explained Feder during an interview. Meanwhile, my earlier film Disclosure took me five years, so this was very accelerated. Our purpose was to generate dialogue so people would know more about the case.

Human Story Amid Political Battle

Although Feder offers a extensive analysis of how prominent news organizations have disseminated anti-trans talking points, the film's greatest achievement may be its captivating depiction of Strangio. That was a major challenge, to open up parts of my life to a documentary crew that I had made efforts to keep private, explained Strangio. Feder explained he wanted future generations to know that we fought, to see what was done in defense of these struggles for our fundamental rights.

The tattoo sequence is among my preferred parts in the movie, stated Strangio. Being tattooed is almost like a meditative experience for me, to be totally engaged in my body and to think of it as a vessel for things that are meaningful to me.

Body Autonomy and Representation

The filmmaker's focus to carefully capturing Strangio getting to his body art underscores that Heightened Scrutiny is fundamentally about trans bodies – not just those of young people who confront restriction of their ability to live genuinely in their own bodies, but also the physical forms of the many participants who are featured in the production.

I produce films with a purpose, and part of that is choosing people who are outstanding and articulate enough to hold the camera, explained Feder. When people ask me what they should wear for an interview, my answer is anything that makes you feel hot. That is essential to me – as trans people, we face challenges so much with our image.

One element that makes Feder's works shine is his evident skill for making his trans subjects feel comfortable, acknowledged and admired. This methodology creates authentic rapport between Feder and Strangio, enabling the filmmaker to accomplish his goal of presenting Strangio as a whole individual and providing a document for future generations of how persistently he and fellow activists have struggled for transgender rights.

I don't want people to find themselves in a place of incessant hopelessness because of what the law is failing to provide us, stated Strangio. I want to be in a process of using the law to lessen harm, but not to make it some sort of pathway for our liberation aspirations. State bodies is not going to be the reflection through which we view ourselves. We are that mirror, and it's really crucial that we persist having that discussion in addition to dialogues about fighting back these regulations and practices.
